Club Rules – Terms and Conditions of Business
Club Rules and Terms of Business are for the interest of safety, responsibility and welfare of our customers (both two and four legged) and other members of the public we may come into contact with. The terms and conditions take effect as soon as you sign up for any service offered or merchandise bought from Jay K9 Ltd. We reserve the right to change these terms and conditions at any time. Changes to Club Rules and Terms and Conditions of Business will be published on our website and are available to customers and may take effect immediately.
1. Training Classes/Sessions/Courses
We limit the number of dogs in our classes/training sessions/courses in order to provide the appropriate trainer to dog ratio. Booking is essential and admittance will not be granted to those that have not booked in advance.
You must not book a dog that is known to show aggression or nervousness onto group training, unless it is a specific course that is intended to address these issues. We reserve the right to exclude dogs that are aggressive in groups unless we have assessed your dog for a re-socialisation. Contact us if you are not sure whether a group is suitable for your dog. If you are unsure about the suitability of your dog in a group situation and have not asked us to assess your dog before your attendance, your fees will not be refunded. If we have agreed to your dog attending, but the dog is not suited to the group, we will offer you alternative arrangements, such as working with you on a one-to-one basis.
Do not crowd doorways and allow plenty of room for dogs to enter and exit the venue. Avoid letting dogs play together outside the venue before class, as this can cause excitement and a lack of attention during the session.
A toilet break before class will ensure your puppy/dog is empty and comfortable. Please be a responsible dog owner and always clean up after your dog.
Please consider others in the group and switch off your mobile phone.
What to Wear:
Our training involves practical handling therefore appropriate shoes and clothing are recommended. Please wear comfortable flat shoes as you will be moving about. You may be required during training to get down to the ground therefore suitable attire is recommended. We train in all weathers and some classes are outside, so please be prepared for the weather. Dogs should wear a fitted flat collar with an ID tag. They may also wear a fixed harness or head collar (head collars should be introduced to dogs appropriately and we offer advice on this where necessary. A halti link should be used with a head collar).
What to bring with you:
Your dog – collar, flat lead (not retractable), head collar or fixed harness (if using), plenty of tasty treats (cocktail sausage, hot dog etc.) a favourite toy or two (avoid squeaky toys please), long lead may be required (we recommend 10 meters rubberised leads, advise on this is available), poo bags. You may also wish to bring a mat and Kong for your dog to rest on and enjoy during breaks between exercises. In groups that require specialist equipment you will be advised in advance of what to bring.
Welfare and safety:
Please keep to areas of the building designated only for our training purposes. All dogs must be kept under the owner’s control. All dogs should remain on a lead, except where specifically instructed by our staff. You are responsible for the conduct of your dog at all times.
Children in class:
We encourage family members to attend classes. Children are welcome, but children under 16 years of age must be accompanied by an adult. Children remain the responsibility of the supervising adult at all times. Children are expected to behave appropriately in the presence of unfamiliar dogs and are requested not to run in class, or distract other dogs from working.
Young children may not find training classes exciting. It can be challenging to supervise young children while training a dog. Very young children can become bored and may need another adult to supervise them. If you provide your children with entertainment during a class, please ensure it is quiet and will not distract the class.
Please arrive in time for your session, latecomers can be disruptive to other dogs who may be working. Dogs arriving late can also find it stressful when enter a group of unknown dogs.
2. 1-2-1 Training sessions:
Training sessions will take place either at your home, our training site or a suitable, agreed location, depending upon the nature of the training. Please see notes in our group sessions above to find further information on what to bring and wear etc.
3. Behaviour Consultations
About your consultation
Behaviour consultations are conducted by Gerry Moss, on occasions she may be accompanied, however you will be asked to approve this beforehand.
A behaviour consultation helps to identify the underlying motivation for any unwanted behaviour. A programme will be devised for your needs based on the behaviour diagnosis and specific to your requirements to help you manage and modify this behaviour. Behaviour issues are often complex, having taken time to develop. Therefore, before proceeding, it is necessary that any potential underlying medical condition or potential cause of pain that could be contributing to your pet’s behaviour is ruled out. Prior to your appointment you will be required to complete and forward the following:
- A vet referral form: To comply with guidelines of the professional organisations to which we belong and to rule out any potential underlying medical causes, you are requested to have your vet complete and sign a referral form.
- Pre-visit questionnaire: This helps build a case history and you should complete this as fully and honestly as possible, citing examples where necessary.
- Video footage: You may be asked to provide video footage of your pet’s behaviour on a day-to-day basis as this can aid the consultation process. It is not necessary to provoke your pet into performing the problem behaviour and we ask that you avoid doing this, but you may already have footage that you can share.
It is important that the above are completed and returned prior to the consultation. Failure to do so may delay the consultation or incur additional costs due to the postponement of the appointment. If you schedule an appointment, but do not return all of the requisites for a consultation at least 48 hours prior to your appointment, we reserve the right to cancel your appointment.
The consultation will take place at your home or online, we may however ask to accompany you on a walk. All dogs should be on lead when first meeting a member of the Jay K9 Ltd. team, whether this is in your house or not. If you have a behaviour concern in relation to aggression or your dog has a bite history, or is aggressive in any way it should be muzzled when first meeting a member of our team. For advice on muzzle training please contact Jay K9 Ltd, as it’s important to get this right! Practical aspects of the program are included and will be demonstrated to you. Please allow up to 2 hours for the initial consultation.
You will receive a specifically devised modification program included within a report explaining what is maintaining the behaviour and how to change it. This will be forwarded to you within 72 hours, along with any help sheets and video tutorials that you may require.
It may be necessary for follow up visits – prices for these are detailed on our website and the same cancellation policy applies.
Animal aggression can cause injury, including fatal injury, to other animals and people. Treatment for aggression is not a guarantee of success and modifying behaviour does not assure that the aggression will be successfully controlled. It is the responsibility of the owner/handler to ensure that their dog does not do harm in the future. Precautions may involve, but are not limited to; keeping a dog on a lead, the use of a muzzle, informing others of the dog’s aggressive tendencies, not mixing with certain types of people or other dogs, or confinement behind fencing and doors. Owners remain responsible for their dogs at all times and are advised to have adequate pet or household insurance cover for liability in the event of damage or injury caused by their dog to property or a third party. It is strongly recommended that your dog is insured for third party liability with or without vet cover.
4. Online Subscriptions
You will be billed in advance on a recurring and periodic basis (billing cycle). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a subscription. At the end of each billing cycle your subscription will automatically renew under the exact same conditions unless you cancel it or Jay K9 Ltd. cancel it. You may cancel your subscription renewal either through your online account management page or by contacting Jay K9 Ltd. A valid payment method, including credit card or PayPal is required to process the payment for your subscription. You will provide Jay K9 Ltd. with accurate and complete billing information including full name, address, state, zip code, telephone number and a valid payment method. By submitting such payment information, you authorise Jay K9 Ltd.to charge all subscription fees incurred through your account to any such payment instruments. Should automatic billing fail to occur for any reason, Jay K9 will issue an electronic invoice indicating that you must proceed manually within a certain deadline date with full payment corresponding to the billing period as indicated on the invoice. Jay K9 Ltd. at it’s own discretion and at any time may modify the subscription fee. Any subscription fee change will become effective at the end of the then current billing cycle. Jay K9 Ltd. will provide you with reasonable prior notice of any change in subscription fees to give you an opportunity to terminate your subscription before such change becomes effective. Your continued use of the service after the subscription fee change comes into effect constitutes your agreement to pay the modified subscription fee amount. Except when required by law, pad subscription fees are non-refundable.
When you create an account with Jay K9 Ltd. you must provide information that is accurate, complete and current at all times. Failure to do so constitutes a breach of the terms, which may result in immediate termination of your account on our service. You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password, whether your password is with our service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.
You will remain respectful to all those who you may come into contact with as a result of your subscription with Jay K9 Ltd. Abusive language or comments will not be tolerated and may result in the termination of your account. We may terminate or suspend your account immediately without prior notice or liability for any reason, including and without limitation if you breach the terms. Upon termination your right to use the service will immediately cease. All provision of the terms shall survive termination including and without limitation: ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Payment is required in full at the time of booking and prior to attendance. If booking a ‘package’ of sessions the total fee must be paid at time of booking first appointment. All subsequent appointments must be booked within the specified time frame. Classes, courses, appointments and 121 bookings are made on a first-come-first-served basis. By registering with us and paying for your course/class/session you have acknowledged that you are aware of our terms and conditions. Confirmation of your booking will be forwarded to you by email. It is the client’s responsibility to ensure they arrive at the right venue, at the correct time. Jay K9 Ltd. reserves the right to refuse attendance for all courses and training services. Areas in excess of 15 minutes travel time incur additional mileage – please discuss this at time of booking.
Cancellations for a course that has been paid for requires at least 48 hours notice. Course fees will not be refunded if cancellation occurs within 48 hours notice of the course starting. We are unable to refund course fees once the course has commenced and partial refunds for missed sessions are not given. No refunds are given for non-attendance to a course.
If you need to cancel your appointment please inform Jay K9 Ltd, providing 48 hours notice. Cancelled appointments inside this notice period will not be refunded. If you would like to rearrange a session rather than cancel the following applies:
- 2 weeks+: full refund simply swap the date of your session
- Between 2 weeks and 1 week: 50% refund on original booking and 25% discount on your re-arranged booking.
- Less than 1 weeks’ notice: no refund on original booking and 50% discount on your re-arranged booking.
- Less than 72 hours: no refund on original booking and 25% discount on your rearranged booking.
- Less than 48 hours notice: no refund and no discount on rearranged bookings.
In case the participant or participants’ dog becomes ill, so that they cannot take part in the event/service, you have to show a doctor’s or licensed veterinarian note stating such. You will then be signed up for the next possible course to make up for the one you could not attend. Alternatively you may find a replacement to take your place.
Requests for a refund and any cancellations, including for 1-2-1s will be at the discretion of Jay K9 Ltd. and any decision is made on a case-by-case basis.
If our sessions are unable to go ahead you will be notified by email as soon as possible. Insufficient numbers booked onto a course may result in the course being postponed or cancelled. In this instance you will be notified of future course dates or offered private tuition. Jay K9 Ltd. reserves the right to postpone or cancel an event/service. If the trainer/instructor falls ill or cannot hold the event/service for other reasons Jay K9 Ltd. will postpone the event or another similarly qualified instructor will hold the event. If the event/service takes place with a smaller group, Jay K9 Ltd. reserves the right to shorten the time/length of the event/service accordingly. Jay K9 Ltd. will not refund any costs that are caused by a third party (e.g. flights, hotels, travel). Jay K9 Ltd. reserves the right to withdraw from a contract without having to obey a timeline/date, especially when a participant does not obey the contract and/or breaks any animal right laws/guidelines. This also applies if the participant puts others and/or their dog/s in danger, or they and/or their dog is not sufficiently insured.
Dog’s Health & Fitness
Welfare and safety of all dogs is paramount to us. Dogs in an unfit state of health due to illness, disease or injury cannot be brought to sessions. Do not bring your dog to a class if they have been in contact with an infectious disease, such as kennel cough or conjunctivitis. If you are unsure as to whether your dog is well enough to attend, please refer to your vet.
Dogs should be adequately protected by vaccination as advised by your vet and verification may be requested. Puppies can attend our classes once they are fully vaccinated. For all puppies’ wellbeing verification of vaccination status must be provided prior to courses starting. Failure to provide confirmation will result in puppies not being able to participate in class.
Bitches in season are not permitted to attend class without specific authorisation from Jay K9 Ltd.
Exchange and Refund
If you bought merchandise from Jay K9 Ltd., we are happy to offer a refund or exchange on any product purchased, provided it is returned in perfect condition (unwashed, unworn and no damage) together with a valid receipt within 28 calendar days of purchase. Items that have been purchased can be exchanged. In all cases, the postage for a return or an exchange is to be paid by the person/s who have bought the merchandise.
Intellectual property rights:
The Jay K9 Ltd. video links, website and its content, including, without limitation, the design, text, graphics and all software and source codes connected with the website and its services are protected by copyright and other intellectual property rights and legislation. In accessing the website, you agree that you will access the contents solely for your personal non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted or distributed without the prior written consent of the copyright holder. For emailed or downloadable handouts and factsheets, permission is granted for one copy to be printed per owner for personal use. Handouts and fact sheets cannot be altered, modified or reworded for further distribution. Photographs, video or any graphics cannot be used without the accompanying text or without obtaining the permission of the copyright holder. Material from this website is for personal use only and is not to be redistributed. To our knowledge, the books, DVDs, training devices or equipment sold or promoted via this website are to promote only kind, fair and effective methods. We do not intend to endorse any material that advocates the use of punishment or harsh methods. Opinions and advice given through this website via these materials may not reflect those of Jay K9 Ltd.
We will not take responsibility if advice is misrepresented. Our advice, training and behaviour plans have been designed individually for the dog/customer they have been issued to so please do not share these with others.
Length of event/service
The trainer/organiser will determine the length of the event/seminar based on the progress of each participant and their dogs. The trainer will act in the best interest of the dog and can therefore order a rest for a dog or put a halt on further training sessions.
Liability and insurance
Participation in any service or event offered by Jay K9 Ltd. is at your own risk, which means the insurance lies with the participant/s themselves. We therefore make you aware that you have to be insured to be able to participate in any event/service. The participant is fully liable for any damages/harm done by either themselves, their dogs or the people that came with them. Jay K9 Ltd. cannot be held liable for any losses of any kind that arise from this contract or the provision of our services save for death or personal injury caused by negligence. This clause does not attempt to avoid any liability which cannot be excluded by law. Jay K9 Ltd. and it’s trainers/instructors do not take any responsibility for any damage/harm done to a person/s or thing/s (e.g. buildings, cars, dogs, personal belongings etc.). You must be able to prove your dog is insured if requested to do so. The participant takes the full responsibility for his/her dog/s, even if acting upon the instruction of a trainer/s. You are fully responsible for your own dog’s actions. Jay K9 Ltd. cannot be asked to take over any costs for damage or harm done to you or your dog/s. Jay K9 Ltd. does not take any responsibility in case of injury or death of your dog/s, other animals or yourself or third parties. Jay K9 Ltd. takes all reasonable precautions within the structure of our training sessions/workshops/courses/classes/121s to avoid injury resulting from dog bites. However, Jay K9 Ltd. accepts no responsibility for damage or injury resulting from dog bites occurring to clients or their dogs while attending sessions. The Control of Dogs Act 1986 section 21 – “Liability of owner for damage by dog” applies within our sessions on our premises or public premises (rented or third party owned). All instances of accident or injury must be reported to the dog trainer/instructor at the time they occurred.
You may not use any gadget or device in class that we consider aversive, such as slip leads, pinch collars, spray collars, compressed air canisters, rattle cans or water squirters, or any other device or method, that has the potential to cause injury, pain or fear. Any handler who continues to use harsh methods when asked not to, will be asked to leave our classes and not return.
Any individual participating in our sessions does not then qualify to teach others the skills and methods we pass on. Participants agree not to conduct/hold/offer such or similar, to the general public or another business or third party.
No guarantee of success
Jay K9 Ltd. will not guarantee any success during or after any event or service.
With signing-up for a service provided by Jay K9 Ltd., payment is expected immediately. If not done so, Jay K9 Ltd. reserves the right to refuse participation in services you have signed up for. Fees and prices are subject to change without notice. Price at time of booking applies. All services must be prepaid. No admittance will be allowed unless the course fee has been paid in full. If you wish to pay cash, please email us for details.
Pictures and videos
Jay K9 Ltd. reserves the right to take pictures and videos during an event/service. Every participant herewith agrees for these to be published on the website, social media or written form. Participants are not allowed to take pictures, videos etc. without the consent of the other participants and Jay K9 Ltd. Participants are not allowed to publish any pictures, videos, voice recordings, text, information gained in any way. If you do not want to be filmed or photographed (or your dog), you need to let Jay K9 Ltd. know in writing. The owner allows and consents for their dog to be photographed, videotaped, and/or used in any media or advertising by Jay K9 Ltd. without prior approval. All such photographs and videos etc. are the property of Jay K9 Ltd.
All training provided will be by instructors who have been trained by Jay K9 Ltd. and have been deemed by Jay K9 Ltd.to have the necessary experience and skills.
We provide as safe and secure an environment as practicably reasonable and endeavour to apply good practices within all our training services. We endeavour to run all sessions in as safe and professional manner as possible. Jay K9 Ltd. takes all reasonable precautions when providing behaviour services to minimise the risk of injury. However dog training is not without risk therefore participation in services are at the owner’s risk. Jay K9 Ltd. or any of its individual assistants, or helpers, will not accept responsibility for loss, injury or damage to any persons, or dogs attending a course, or their property howsoever caused during the provision of dog training activities.
You can sign up through: online booking, email, bank transfer, cheque or cash. No telephone or spoken sign-ups are possible. The sign-up means you are bound by these terms. Once signed up you will receive a confirmation email. Jay K9 Ltd.is allowed to refuse participation to anyone without having to give a reason.
Vehicles are parked at your own risk
These terms and conditions have been authored to assist our clients in getting the most they can from Jay K9 Ltd. Our terms and conditions may change over time. The Club Rules and Terms and Conditions of Business apply at time of booking. Revised terms and conditions apply to subsequent bookings.
Jay K9 Ltd. has no liability in respect of the content of other websites that are linked to or from www.jayk9.co.uk or other Jay K9 Ltd. Related social media sites. These provisions (terms, conditions, disclaimers and exclusions) shall be construed in accordance with the laws of England. If any of these provisions are deemed or found to be unlawful, void or for any reason unenforceable then the provision or provisions so found shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. Any and all disputes arising will be subject to the exclusive jurisdiction of the courts of England and Wales. By booking an event/service or attending a training session or other service of Jay K9 Ltd. you agree to be bound by these terms and conditions.
